With the incapacity of an individual, all decisions cease unless an attorney-in-fact or Power-of-Attorney is named. The client can choose who is to act in place of themselves in case they find themselves unable to do so. GUARDIANSHIP OF THE ESTATE
When an adult is found to be an incompetent individual by the court and that individual has financial assets, a Guardian of the Estate must be bonded and appointed. SEP will serve as this fiduciary in a lawful and efficient manner by filing all required accountings and meeting all court deadlines and requirements.

With the incapacity of an individual all medical, health, and living arrangements can be made through a Healthcare Power of Attorney. The client chooses who will serve in this important role if they find themselves in need of someone. SEP will guide and advise the client through this process and explain why a Healthcare Power of Attorney is needed.

SEP will provide guidance as to the client’s end-of-life decisions should they become terminable and incurable or in a coma. This important decision is made by the client so their loved ones won’t have to.

PARTITION SALES
When tenants-in-common of real property can’t decide how that property is to be divided or sold, any one of the property owners can petition the court for a division. SEP can guide the client through this complicated process and served as commissioner if the property is sold.

STAND-BY GUARDIANSHIPS
A parent can decide who will best serve as their minor child’s guardian in case the parent dies unexpectedly or becomes incapacitated. This process can also be used by a current guardian to choose who will best serve as a guardian for an incompetent adult in cases where the current guardian themselves die or becomes incapacitated.
